Compliance Minute: COBRA Continuation Coverage

Both federal and state law give certain individuals who would otherwise lose coverage under a group health plan, the right to continue their coverage for a temporary period of time under specified circumstances.

Federal COBRA (Consolidated Omnibus Budget Reconciliation Act of 1986) and New York “mini-COBRA” each contain several notice and procedural requirements related to coverage continuation. While the laws are similar in some ways, they also have unique provisions and applicability.
